Abstract

The research deals with the distinction between cursing and its effects. My study was divided into an introduction, two sections, and a conclusion. Cursing is the husband’s oath against his wife’s adultery, or denying her necessary pregnancy for him. The evidence of its legitimacy is proven by the Qur’an, Sunnah, and consensus. Its ruling is obligatory, disliked, and forbidden, and in the wisdom of its legitimacy there is relief and a way out for what Husbands may suffer harm due to the adultery of their wives, and it is required that the cursing be at the hands of the ruler or his deputy, and after the ruler separates the cursing parties, it results in a set of rulings, such as eternal inviolability between the cursing parties, the forfeiture of the right to pleasure, maintenance, and housing for the cursing person, denying the lineage of the child and attaching him to his mother, and the punishment penalty is waived. Slander is on the part of the husband and the right to adultery is on the wife, and it is not inherited between the two who are in love with each other. As for the son, he in herits from his mother and inherits from his siblings.
