Patient Protection Against Medical Errors in Civil Law

Abstract
This study aims to determine the legal nature of medical errors to ensure patient protection. It explores the concept of medical error and the foundations of civil liability in both its contractual and tortious aspects. Furthermore, the study examines the implementation of mechanisms that provide civil protection for patients and highlights the judiciary's role in ensuring this protection by awarding fair compensation commensurate with the damages sustained as a result of such errors.
