Abstract

Divorce due to harm is a fundamental topic in personal status laws and legal texts, given its direct connection to marital life and family stability. Divorce due to harm is viewed as a legitimate means of protecting one spouse, often the wife, from harm and abuse inflicted upon her by the other spouse. Divorce due to harm is a lawsuit filed by a wife in family court seeking a divorce because her husband has inflicted physical or emotional harm upon her (such as physical abuse, abandonment, failure to provide financial support, marrying another woman, or insults) that makes continued cohabitation impossible. This requires proof through witness testimony, police reports, or medical reports. The judge issues a final divorce decree, and the wife retains her legal rights.
