The Conflict of Qiyas with the Statement of the Companion – An Applied Usul Study.
Main Article Content
Abstract
This research discusses the fundamental issues related to the statement of a companion when it conflicts with analogy, considering that both are legal proofs that differ in their validity and levels.
Hence my choice of this title: .(The conflict between analogy and the statement of the Companion: an applied fundamental study)
The importance of the research lies in knowing the analogy, its pillars and conditions, as well as explaining the forms of conflict between the analogy and the statement of the Companion, which is the conflict in matters of ijtihad. Usually, the Companion establishes a ruling that contradicts the clear analogy, or there is a general analogical rule and the Companion deviates from it with a special ruling. Usually, the statement of the Companion is given precedence over the analogy if its chain of transmission is stronger than the analogy, especially in understanding texts.
The induction in this research indicates that the conflict between analogy and the statement of the Companion hardly goes beyond the issues of ijtihad in general, which necessitates the application of the fundamental rules of preference when it occurs in order to determine which of them should be acted upon .
This study has been divided into three sections. The first section: Study terms: analogy, contradiction, and the statement of the Companion. The second section: The location and ruling on the contradiction of the statements of the fundamentalists regarding the contradiction and preference between analogy and the statement of the Companion. The third section: Applied issues in the contradiction of analogy with the statement of the Companion.
