THE LAWYER'S CIVIL LIABILITY FOR THE ACTIONS OF OTHERS

Abstract

This paper examines the vicarious liability of a lawyer for errors committed by third parties engaged to assist in fulfilling the lawyer’s obligations. It addresses the basis of such liability and reviews the nature of the lawyer’s liability toward those whom the lawyer engages in performing his duties, in terms of whether this liability constitutes contractual or tortious liability. Additionally, the paper discusses the vicarious liability of a principal for the acts of an agent.
