The Phenomenon of Disobedience: Its Causes and Remedies — An Analytical Study

Abstract
This study aims to clarify the concept of nashuz in Islamic jurisprudence, identify its causes and manifestations, and outline its legal and social implications, particularly within a society where legal rulings have become intertwined with social customs, and in light of the contemporary challenges and developments facing Muslim societies in particular, with a view to proposing solutions to curb the spread of this problem, whilst highlighting the Islamic approach to addressing it, in order to fulfil the objectives of Sharia in preserving the family, safeguarding rights, and establishing the values of justice and compassion between spouses. Disobedience is one of the greatest problems facing the family amidst life’s challenges, such that married life cannot continue whilst disobedience exists on the part of one or both spouses, Hence, Islamic legislation seeks to combat domestic corruption and safeguard the family structure from all that threatens or undermines its stability. Disobedience is one of the issues that Islam has addressed with a balanced and just approach, based on mercy and justice.
