Abstract

This legal thesis reveals a jurisprudential reality that guides it within the context of legal writing in light of the jurisprudential schools of thought, and the extent of the value of Islamic law and its impact in establishing laws that would accommodate international agreements and modern developments. The issues of these laws, as selected jurisprudential material in their legal forms, are considered a gain and a scientific addition. It aims to renew the legislative situation through the path of codification in the schools of jurisprudence. Its importance is also evident in the fact that it represents the first draft law of Hanafi jurisprudence in the Arab countries that came to regulate relations in the ownership of foreigners. It aims to provide the legal system with legal drafting approaches derived from schools of Islamic jurisprudence.
