Mandatory Intervention of the Public Prosecution in Civil Lawsuits

Abstract
The intervention of the Public Prosecution in civil cases is considered one of the important subjects in procedural law due to its role in protecting public interest and ensuring the proper application of the law. In principle, civil disputes are conducted between private individuals without the involvement of the Public Prosecution. However, the Libyan legislator has made its intervention mandatory in certain cases related to public order or affecting society, family matters, and persons lacking legal capacity, in order to achieve justice and protect rights. The research problem centers on identifying the legal basis for the mandatory intervention of the Public Prosecution, determining the cases in which such intervention is required, and explaining the legal consequences resulting from the absence of this intervention in civil proceedings. The study addressed the concept of Public Prosecution intervention and its legal nature, while distinguishing it from the intervention of third parties in litigation. It also examined the legislative basis for mandatory intervention under the Libyan Code of Civil Procedure, especially in cases concerning personal status, legal capacity, nationality, and matters in which the law requires prosecution involvement to safeguard public order. The research clarified that the intervention of the Public Prosecution may be original or accessory; however, mandatory intervention obliges the court to notify the prosecution and allow it to present its opinion before issuing judgment. Failure to do so may render the judgment void due to the violation of an essential procedural rule. The study also emphasized that the role of the Public Prosecution in such cases is not intended to achieve a private interest, but rather to protect legality, uphold justice, and ensure respect for rules connected to public order. The research concluded that the Libyan legislator granted the Public Prosecution an important role in certain civil cases because of their legal and social significance, and that mandatory intervention constitutes an essential guarantee for the proper administration of justice. The study recommended developing procedural provisions related to prosecution intervention and clarifying more precisely the cases in which such intervention is mandatory, in order to achieve judicial stability and unify judicial practice before the courts.
